I am an immigrant who has been granted Temporary Protected Status (TPS) by U.S. Citizenship and Immigration Services (USCIS). Am I eligible for coverage through Virginia's Insurance Marketplace?
Yes. An immigrant who has been granted Temporary Protected Status (TPS) by USCIS is considered lawfully present and, therefore, eligible for coverage through Virginia's Insurance Marketplace.
On the Virginia's Insurance Marketplace application, you will need to document your immigration status as having Temporary Protected Status. In the section of the application that asks for visa and immigration information, be sure to complete all required information.
A list of documents that immigrants may use to verify their immigration status with Virginia's Insurance Marketplace is available in Documents to Confirm Your Immigration Status – Virginia's Insurance Marketplace Help. These documents may also be used to verify Temporary Protected Status.
I am an immigrant who has applied for Temporary Protected Status (TPS) with U.S. Citizenship and Immigration Services (USCIS). Am I eligible for coverage through Virginia's Insurance Marketplace?
Yes. An immigrant who has applied for Temporary Protected Status (TPS) with USCIS is considered lawfully present and, therefore, eligible for coverage through Virginia's Insurance Marketplace.
If you have applied for TPS but have not yet received a determination from USCIS, you may still be eligible for coverage through Virginia's Insurance Marketplace. Virginia's Insurance Marketplace considers a pending TPS application with USCIS to be an eligible immigration status for Marketplace coverage because the amount of time required to receive a determination may vary and can be lengthy.
If my application for Temporary Protected Status is denied by USCIS, will I be eligible to enroll in Virginia's Insurance Marketplace?
If your application for TPS is ultimately denied by USCIS, this may affect your eligibility for coverage through Virginia's Insurance Marketplace.
A person who does not have a qualifying immigration status is not eligible to enroll in or maintain coverage through Virginia's Insurance Marketplace. If you are not granted TPS and do not have another qualifying immigration status, you may become ineligible for coverage through Virginia's Insurance Marketplace.
Once USCIS has made a determination on your TPS application, you should contact Virginia's Insurance Marketplace to report the determination or update your information through your Virginia's Insurance Marketplace account online.
