If you're incarcerated, meaning you have been convicted and are serving a term in prison or jail, you cannot enroll in a health plan through Virginia's Insurance Marketplace. This does not include individuals that are awaiting disposition of charges.
Incarceration doesn't include being on probation, parole, or home confinement.
You're not considered incarcerated if you are in jail or prison and have not been convicted of a crime. In that case, you can create and account or log in to Virginia's Insurance Marketplace to apply for a private health insurance plan.
Once you are released, you qualify for a 60-day Special Enrollment Period. During this time, you can sign up for health coverage through Virginia's Insurance Marketplace, even if it is outside of the regular Open Enrollment Period (Nov.1-Jan 30, 2026).
